Discharge on Title for Orders to Comply

An Order to Comply is a formal written warning issued when a building or structure must be brought into compliance with the Ontario Building Code by a specific date. In certain circumstances, the City of Brampton Building Division will register this Order on the title of the property. 

Why is this registered on my title?

Registering an Order to Comply ensures that any person with an interest in the property, current or future, are made aware of the outstanding requirements and are subject to the Order to Comply concerning that property. 

The Discharge Process

The City will only discharge an Order from a property title once the property has been brought into full compliance. Achieving compliance typically involves the following steps: including but not limited to: 

  • Permits: Obtaining a building permit for any as-built construction.
  • Inspections: Successfully closing the permit and clearing the Order through passed inspections.
  • Payment: Paying the required Discharge on Title fee. The Construction Prior to Issuance fee may also be fee may also apply if the Order relates directly to the permit application.
Important: Payment of the discharge fee alone does not constitute compliance and will not result in the Order being removed from the title. 

Fees and Payment Options

​​​The Discharge on Title fee and Construction Prior to Issuance fee must be paid in full before a building permit can be issued. 

There are three ways to handle outstanding Discharge on Title fees:

  1. ​Brampton Portal: If a permit is active, you can log in to the Brampton Portal​ to view and pay outstanding fees listed on the Fees & Payment page.
  2. In-Person: Payments can be made at the Building Division counter at 8850 McLaughlin Rd S.
  3. Electronic Link: For certain files not yet attached to a permit, you may receive a direct payment link via email from Building Division staff.

When can I ​​pay the discharge fee?

Payment can be made at any time during the permit process.

Will this hold up m​​​y Occupancy Certificate?

No. The City generally does not hold up the issuance of an Occupancy Certificate solely because the Discharge on Title fee remains unpaid, as there are other methods used to collect these fees.

What if m​​y permit was revoked?

Revoked permits may still have Discharge on Title fees owing if the Order was registered. The City actively follows up to collect these outstanding amounts.​​
